    Terms and Conditions: Terrachow

    Welcome to Terrachow. By accessing or using our platform (the “Platform”), you agree to these Terms and Conditions. Please read them carefully before using our services.

    1. Food Ordering and Delivery

    a. Terrachow partners with restaurants (“Restaurant Partners”) under contractual arrangements to list menu items and enable customers (“Customers”) to place orders for food and beverages through the Platform.

    b. Customers may browse and place orders directly against Restaurant Partners on the Platform.

    c. By placing an order, you grant Terrachow an unconditional authorization to transmit your order to the respective Restaurant Partner on your behalf.

    d. Delivery of your order may be carried out:

    • Directly by the Restaurant Partner, or
    • Through independent third-party delivery riders (“Delivery Partners”) facilitated via Terrachow.

    In either case, Terrachow acts only as an intermediary and does not itself provide delivery services.

    e. Acceptance of a delivery task by a Delivery Partner constitutes a contract of service directly between you and the Delivery Partner. Terrachow is not a party to such a contract and shall not be liable for delays, tampering, quality issues, or delivery errors attributable to Delivery Partners.

    f. Orders may sometimes be grouped or batched with other deliveries for efficiency.

    g. Delivery fees (“Delivery Charges”) may apply, determined by factors such as distance, restaurant, order value, or time of day. Terrachow collects these charges on behalf of the Restaurant Partner or Delivery Partner. You remain responsible for all applicable Delivery Charges.

    h. During periods of high demand, an additional Delivery Surge may apply. This is calculated based on distance, demand, traffic, weather, or peak seasons. Terrachow will make reasonable efforts to notify you before confirming your order.

    i. For every order, Terrachow will provide necessary documentation such as order summaries or receipts, in line with applicable regulations.

    j. You must treat Delivery Partners with dignity and respect. Discrimination based on race, gender, religion, disability, age, sexual orientation, or other protected grounds is strictly prohibited. Harassment of Delivery Partners, including sexual harassment, will not be tolerated.

    2. Prices and Payments

    a. All menu prices displayed on Terrachow are provided directly by the Restaurant Partner. Prices may include packaging or handling charges. The final price may vary depending on the Restaurant Partner’s actual charge at the time of preparation.

    b. Delivery Charges, Delivery Surge, and applicable taxes will be displayed at checkout.

    c. Payment must be completed in full at the time of placing your order. Terrachow does not store debit or credit card details.

    3. Cancellations and Refunds

    a. Service charges are non-refundable if an order is cancelled:

    • By the vendor due to item unavailability, or
    • By the customer for any reason.

    b. Delivery fees are non-refundable if:

    • The customer cancels the order after the rider has already picked up the food or left the restaurant, within the specified time.

    c. Refunds will only be processed in cases where:

    • The Restaurant Partner confirms, and
    • The issue falls under Terrachow’s resolution policy (e.g., wrong order, food spillage, order not delivered).

    d. Refunds are processed in the same manner as payment was made, subject to bank processing timelines.

    4. Order Issues

    Terrachow is not the manufacturer, seller, or distributor of food items. Responsibility for quality, safety, and compliance lies solely with the Restaurant Partner.

    Customers must review food descriptions before ordering, especially for dietary restrictions or allergies. Terrachow is not liable for unmet dietary needs.

    5. Customer Obligations

    • You must provide accurate contact and delivery details.
    • You must not resell food purchased via Terrachow.
    • You must be available at the delivery address to receive your order.

    6. Order Deletion

    If you delete your order history from the Terrachow app:

    • The order will no longer appear in your history and Terrachow will not provide support on deleted orders.
    • Deleted order data may still exist in backups, emails, SMS records, or Restaurant Partner records, in line with the Privacy Policy.

    7. Limitations of Liability

    • Terrachow shall not be liable for acts or omissions of Restaurant Partners or Delivery Partners.
    • Terrachow is not responsible for delays caused by traffic, weather, strikes, or other unforeseen events.
    • Delivery times are estimates only and may vary.

    8. General Provisions

    • These Terms are subject to change without prior notice. Updates will be reflected on the Platform.
    • By continuing to use the Platform after updates, you accept the revised Terms.
    • These Terms are governed by the applicable laws of your jurisdiction.
